Deep Docket: ChatGPT Banned for Legal Advice? / Perplexity Patents / The Rise of Specialist AI

Show notes

The OpenAI "Legal Advice Ban": Why the social media headlines were wrong. What the new Terms of Use update really means for your professional liability as an attorney or in-house counsel.

Perplexity Patents Enters the Game: A first look at the new, dedicated AI patent research agent. We break down its two most powerful features: semantic search (understanding "fitness trackers" vs. "health wearables") and blended non-patent literature (NPL) search.

Announcing "Claim Drafter": An announcement about Bastian's new specialist AI tool for patent practitioners, Claim Drafter, and its official public launch on November 18th.

The Big Takeaway: Why these stories show a clear trend: the market is moving away from generalist AI and rewarding specialized, precision tools.

00:00:01: The deep docket, your insider briefing on AI and patents.

00:00:05: I'm your host, Bastian Best, and these are the top news this week.

00:00:10: Did OpenAI just ban lawyers from using chat GPT?

00:00:14: The answer is no, but the real story is far more important.

00:00:18: Also, Perplexity AI makes a direct play for the patent search market.

00:00:23: And a special announcement from my own AI-powered patent drafting toolkit.

00:00:32: This week everyone in my LinkedIn feed was freaking out about Open AI's new terms of use.

00:00:38: You may have heard the headlines claiming Open AI just banned JetGPT from giving legal advice.

00:00:45: This was sparked by a policy update which prohibits using JetGPT for, and I'm quoting, the provision of tailored advice that requires a license, such as legal or medical advice, without appropriate involvement by a licensed professional.

00:01:02: So, let's clear the noise.

00:01:03: This is not a new ban.

00:01:05: This isn't about a change in function.

00:01:06: It's about a change in liability.

00:01:10: OpenAI knows legal professionals are using the tool and this clause officially shifts the liability from them, OpenAI, to the appropriately involved licensed professional.

00:01:22: So what does this mean for your practice as a patent attorney?

00:01:26: Well, this is your explicit note that you are the human in the loop and you bear one hundred percent of the responsibility.

00:01:34: It doesn't mean stop using JGBT, but it does mean you must review every single word.

00:01:41: Second, a new player has entered the prior art search game.

00:01:45: Perplexity AI, the company known for its citation focused answer engine, has launched perplexity patents.

00:01:53: Now, this isn't just another chat GPT for patents, but what makes it interesting are two core features.

00:01:59: First, it uses semantic search, not just keyword search.

00:02:03: So, for example, it understands that a query for, let's say, fitness trackers also should find patents for health monitoring variables.

00:02:14: Second, it seems to search non-patent literature at the same time, pulling in things like academic papers, technical blogs and even GitHub code repositories.

00:02:25: That looks like it could be a huge step toward automating a true state-of-the-art analysis.

00:02:32: So my bet is that on the one hand this is not going to replace your professional search tool or search provider tomorrow, but for R&D teams and for patent managers doing initial landscaping or novelty checks, this could be a powerful new tool.

00:02:50: For patent attorneys, an interesting use case might be for drafting, for example, the background section of a patent application.

00:02:57: So using this to get a quick overview of the prior art could be a massive time saver.

00:03:03: And finally, a special announcement I'm incredibly excited to share.

00:03:07: For the past several months, I've been developing my own first AI tool called ClaimDrafter.

00:03:13: It is officially launching to the public on November eighteenth.

00:03:17: So this isn't another one-click patent drafting robot.

00:03:20: It's a professional grade assistant for practitioners.

00:03:23: I've designed it to be kind of a second set of eyes to help you iterate, refine and stress test your patent claims using a structured thinking process that is based on the EPO's problem solution approach.

00:03:37: If you want to get on the launch list, you can sign up at powerclaim.io.

00:03:42: That's powerclaim.io.

00:03:45: So, what's the unifying threat this week?

00:03:47: The theme is specialization.

00:03:50: The Open AI story shows the clear limits and liabilities of a generalist AI hitting the wall of professional responsibility.

00:03:59: It highlights why a general purpose tool isn't the final answer in our field.

00:04:04: And that's why the other two stories are the future.

00:04:06: We are seeing the rise of specialist tools, perplexity patterns for semantic search, and tools like my claim drafter for the high stakes, very specific tasks in a patent drafting workflow.

00:04:19: So the future of AI in patents isn't chapped, it is precision.

00:04:23: That's all for the deep docket this week.

00:04:25: For more, subscribe to this podcast.

00:04:28: I'm your host, Bastian Best.

00:04:30: Talk to you next week.

00:04:31: Game over.
